


What is Trademark?
A trademark is a sign used to distinguish the goods or services provided by different traders. A trademark may consist of words (including personal names), symbols, designs, letters, characters, numbers, graphic elements, colors, sounds, scents, the shape of goods or their packaging, or any combination of these elements. Only marks that can be represented in writing or visually can be registered as trademarks.
Why Trademark?
Once your trademark is registered, you obtain the exclusive right to use the trademark in relation to the relevant goods and services. If other traders use the trademark on identical or similar goods or services in Hong Kong without your consent, it constitutes an infringement, and you are entitled to take legal action to protect your rights. Conversely, if the trademark is not registered, it is more difficult to prove that you are the legitimate owner of the trademark, and the legal protection available to you is considerably limited.
